We may ignore the opposition of related domestic producers "unless such domestic
producers demonstrate that their interests as domestic producers would be adversely
affected" (see section 19 CFR 351.203(e)(4)). This puts the burden of demonstrating
such an effect on those producers. We consider related domestic producers to be either 1)
a domestic producer related to a foreign exporter, or 2) a domestic producer related to a
foreign producer. In addition, we may also disregard the views of domestic producers
who are also importers of the subject merchandise and domestic producers who are
related to such importers. In evaluating whether to disregard such producers, the DOC
may consider the import levels and percentage of ownership common to other members
of the domestic industry.
국내의 관련산업 생산자의 반대는 이들이 관련산업의 국내 생산자
이익이 반대로 침해될 것이라는 점을 입증하지 못하면 반대로 무시될 수
도 있다(19 CFR 351.203(e)(4) 참조). 이는 이익침해의 입증책임이 관련
산업 생산자에게 있다는 것이다. 국내관련산업의 생산자라 함은 1) 해외

자를 무시할 지를 판단함에 있어서 상무부는 수입규모와 국내산업의 여
타 기업과 공통된 소유권의 비중 등을 고려할 수 있다.
