As noted above, public versions of documents containing public summaries or an
explanation of why business proprietary information cannot be summarized are required
to be filed one business day after the due date of the business proprietary version of the
document with the final business proprietary version of the document. As explained
below, failure to submit a proper public version of the business proprietary document will
result in the rejection of the business proprietary document. The summaries must be
sufficiently detailed to allow a reasonable understanding of the business proprietary
information contained in the submission. 19 CFR 351.304(c)(1) permits a party to claim
that summarization is not possible. However, the regulations also state that the DOC will
vigorously enforce the requirement for public summaries, and will grant claims that
summarization is impossible only in exceptional circumstances. Parties may only
publicly summarize their own business proprietary information.
No party should publicly summarize another party's business proprietary information
because it may lead to the improper disclosure of the information which would be a
violation of the APO.
