Success often bears within itself the seed of destruction, for it may very
well cut the author off from the material that was its occasion.
He enters a new world. He is made much of. He must be almost super-human if
he is not captivated by the notice taken of him by the great and remains
insensible to the attentions of beautiful women. He grows accustomed to
another way of life, probably more luxurious than that to which he has
been used, and to people who have more of the social graces than those with
whom he has associated before. They are more intellectual and their superficial
brilliance is engaging. How difficult it is for him then to move freely still
in the circles with which he has been familiar and which have given him his
subjects!

children. He wakes up early in the morning while they are still asleep
and hurries off to his office.
There it is his duty to display the qualities of a great executive; he
cultivates a firm jaw, a decisive manner of speech, and an air of
sagacious reserve calculated to impress everybody except the office boy.
He dictates letters, converses with various important persons on the
phone, studies the market, and presently has lunch with some person
with whom he is conducting or hoping to conduct a deal.
The same sort of thing goes on all the afternoon. He arrives home, tired,
just in time to dress for dinner. At dinner he and a number of other
tired men have to pretend to enjoy the company of ladies who have no
occasion to feel tired yet. How many hours it may take the poor man
to escape, it is impossible to foresee.

체해야 한다. 이 딱한 남자가 그곳을 벗어나는데 시간이 얼마나 걸릴지
알 수 없다.
제2장 외국으로의 촉탁
CHAPTER II ENTRUSTMENT TO FOREIGN COUNTRY
제5조 (촉탁의 상대방) ①외국으로의 촉탁은 수소법원의 재판장이 그 외국의
관할법원 기타 공무소에 대하여 한다.
②수소법원의 재판장은 다음 각호에 따라 외국으로의 촉탁을 할 수 있다.
Article 5 (Other Party of Entrustment)
(1) Any entrustment to a foreign country shall be made by the presiding
judge of the court which has accepted the lawsuit, to the competent court
or other public office of the foreign country.
(2) The presiding judge of the court which has accepted a lawsuit, may make
an entrustment to a foreign country by the following subparagraphs:
1. 송달받을 자 또는 증인신문을 받을 자가 대한민국 국민으로서
영사관계에관한비엔나협약에 가입한 외국에 거주하는 경우에는 그 외국에
주재하는대한민국의 대사·공사 또는 영사에 대하여 한다. 이 경우 그 외국의 법령
또는의사표시에 위배되지 아니하여야 한다.
2. 외국이 명백한 의사표시로써 승인하는 경우에는 그 의사표시에 따른
실시기관에 대하여 한다.
1.If the person to whom the service is to be made, or who is to undergo an
inquiry, is a national of the Republic of Korea, and resides in a foreign
country which is a member of the Vienna Convention on Consular Relations,
the entrustment shall be made to the ambassador, minister or consul of the
Republic of Korea in the foreign country. In this case, it shall not be
contrary to the statute or the declaration of intention of the foreign
country; and
2.If the foreign country approves it by an obvious declaration of its
intention, the entrustment shall be made to the agency implementing such
declaration of intention.
제7조 (번역문의 첨부) ①외국법원 기타 공무소에 대하여 사법공조를 촉탁하는
경우에는 그 외국의 공용어로 된 촉탁서 기타 관계서류의 번역문을 첨부하여야
한다. 다만, 그 외국의 공용어를 알 수 없는 경우에는 영어로 된 번역문을
첨부할 수 있다.
Article 7 (Appending of Translation)
(1) In a case where a judicial cooperation is entrusted to a court or a
public office of a foreign country, the translation of the written
entrustment and other related documents in the official language of the
foreign country shall be appended: Provided, That if such official language
of the foreign country is not known, it may be allowed to append a
translation in English.
②당사자는 수소법원에 제출하여야 할 외국으로의 촉탁관계서류에 번역문을
첨부하여야 한다.
(2) The party shall append a translation to the entrustment-related
documents to a foreign country, which are to be submitted to the court
which has accepted the lawsuit.
③송달받을 자가 외국인으로서 제5조제2항제2호의 규정에 의하여 그 외국의
승인에 따라 그 외국에 주재하는 대한민국의 대사·공사 또는 영사를 실시기관으로
하여송달을 촉탁하는 경우에 그 송달할 서류에 관하여는 제1항 및 제2항의
규정을준용한다.
(3) In a case where a person to whom the related documents are to be
served, is a foreigner, and he entrusts the ambassador, minister or consul
of the Republic of Korea in the foreign country, that he is deemed as an
implementing agency, with a service thereof with the approval of the
foreign country under 2 of Article 5 (2) 2, the provisions of paragraphs
(1) and (2) shall apply mutatis mutandis to such documents to be served.
④제1항 및 제3항의 규정에 의하여 번역문을 첨부함에 따른
번역비용은소송비용으로 한다.
(4) The expenses for translation incurred under paragraphs (1) and (3)
shall be part of the costs of the lawsuit.
